In Tom's defense - even though he is an officer of the Union, he's not a financially compensated one. At least that's what I've been told. He volunteers his time as president.

Every Union artist started out as a non-union one when they first entered the industry. If Tom has hired a non-union artist, then Union artists should bring the matter to his attention. Sito is the last person to let something like this slip past him. This can be handled in a professional manner. Beating him over the head isn't a productive way of resolving the matter.
